These Terms of Service govern access to and use of English AIdol's educational platform, websites, applications, AI-assisted learning features, content tools, subscriptions, and related services. Please read them carefully before using the service.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and English AIdol ("English AIdol", "we", "us", or "our"). By accessing, browsing, registering for, subscribing to, or using any part of the service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you access the service on behalf of an organization, school, company, or other legal entity, you represent that you have authority to bind that entity to these Terms. If you do not agree to these Terms, you must not access or use the service.

2. Description of Service

English AIdol provides English learning, exam preparation, AI-assisted writing and speaking feedback, vocabulary tools, listening and reading practice, study plans, learning materials, and related educational functionality. The service may include web applications, mobile experiences, audio tools, AI tutors, score predictions, content generation features, dashboards, reports, and integrations with third-party platforms.

The service is provided for educational and informational purposes. It is not an official IELTS, TOEFL, TOEIC, PTE, university, immigration, licensing, or government testing service unless expressly stated in a separate written agreement.

3. Eligibility

You must be at least 13 years old to use the service. If you are under the age of majority in your jurisdiction, you may use the service only with consent and supervision from a parent or legal guardian. By using the service, you represent that you meet these eligibility requirements.

4. Account Registration and Responsibility

Some features require an account. You agree to provide accurate, current, and complete information and to maintain the accuracy of that information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must notify us promptly if you suspect unauthorized access to your account. We are not responsible for losses arising from your failure to protect account credentials or from unauthorized activity caused by your actions or omissions.

5. Acceptable Use

You agree to use the service only for lawful, educational, and permitted purposes. You must not:

• Use the service in violation of applicable laws, regulations, third-party rights, or platform rules.
• Upload, submit, generate, publish, or transmit unlawful, infringing, defamatory, abusive, harassing, hateful, exploitative, deceptive, or harmful content.
• Attempt to gain unauthorized access to accounts, systems, data, models, APIs, infrastructure, or networks.
• Interfere with, disrupt, overload, scrape, crawl, reverse engineer, or bypass security or rate-limiting measures.
• Use the service to distribute spam, malware, phishing attempts, fraudulent content, or automated abuse.
• Misrepresent your identity, affiliation, credentials, results, or relationship with English AIdol.
• Use AI outputs as a substitute for professional advice, official test scoring, immigration guidance, legal advice, medical advice, or financial advice.
• Resell, sublicense, or commercially exploit the service except as expressly authorized by us in writing.

6. Educational Results and AI Outputs

English AIdol may provide estimated scores, feedback, corrections, explanations, practice materials, and recommendations using automated systems and AI models. These outputs are educational estimates and may contain errors, omissions, inaccuracies, or interpretations that differ from human examiners or official scoring bodies.

You are responsible for independently reviewing outputs before relying on them. We do not guarantee admission outcomes, official test results, score improvements, certification, employment, immigration approval, or any particular educational result.

7. User Content

"User Content" means content that you submit, upload, record, write, speak, store, generate, or otherwise provide through the service, including essays, answers, recordings, transcripts, notes, files, prompts, feedback requests, and learning materials.

You retain ownership of your User Content, subject to the rights granted in these Terms. By submitting User Content, you grant English AIdol a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, transmit, display, modify, and use the User Content as necessary to provide, maintain, secure, support, and improve the service.

You represent that you have all rights necessary to submit User Content and that your User Content does not violate any law, contract, intellectual property right, privacy right, publicity right, or other third-party right.

8. Intellectual Property

The service, including software, design, text, graphics, interfaces, logos, trademarks, lesson materials, generated site content, databases, workflows, and other materials provided by English AIdol, is owned by English AIdol or its licensors and is protected by intellectual property and other laws.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the service for personal educational purposes or other purposes expressly permitted by us. No rights are granted except as expressly stated in these Terms.

9. Subscriptions, Payments, and Billing

Certain features may require payment or subscription. Prices, features, limits, billing periods, renewal terms, and cancellation rules may be displayed at checkout or in the applicable plan description. By purchasing a paid feature, you authorize our payment providers to charge the applicable fees, taxes, and recurring amounts.

Unless otherwise required by law or expressly stated at checkout, fees are non-refundable. Subscription access may continue until the end of the paid billing period after cancellation. We may change pricing or plan features prospectively, subject to applicable law and notice requirements.

10. Third-Party Services and Integrations

The service may integrate with or link to third-party services, including authentication providers, payment processors, analytics tools, AI providers, content platforms, app stores, video platforms, social media platforms, and cloud infrastructure providers. Third-party services are governed by their own terms and privacy policies.

We are not responsible for third-party services, content, policies, availability, errors, or actions. Your use of third-party services is at your own risk and may require separate accounts, permissions, or approvals.

11. Platform and Social Media Compliance

If you use English AIdol tools to create, prepare, export, upload, or publish content to third-party platforms, you are responsible for complying with the terms, developer policies, content rules, advertising rules, intellectual property rules, and community guidelines of those platforms. We do not guarantee that any third-party platform will approve, publish, rank, monetize, or continue to allow any content or integration.

12. Service Availability and Changes

We may modify, suspend, discontinue, limit, or replace any part of the service at any time, including features, models, content, pricing, limits, supported exams, integrations, or availability. We may perform maintenance, upgrades, or emergency repairs. We do not guarantee uninterrupted, error-free, or permanently available service.

13. Beta Features

Some features may be offered as beta, experimental, preview, or early-access features. Such features may be incomplete, unstable, inaccurate, unavailable, or changed without notice. We may discontinue beta features at any time.

14. Termination and Suspension

We may suspend, restrict, or terminate your access to the service if we believe you violated these Terms, created risk for English AIdol or other users, failed to pay applicable fees, used the service abusively, or if required by law or third-party platform requirements.

You may stop using the service at any time. Termination does not affect provisions that by their nature should survive, including intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, dispute provisions, and related sections.

15. Disclaimers

The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, English AIdol disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and course of performance.

We do not warrant that the service will be secure, uninterrupted, error-free, free from harmful components, or that outputs will be accurate, complete, or suitable for your intended purpose.

16. Limitation of Liability

To the maximum extent permitted by law, English AIdol and its officers, employees, contractors, agents, suppliers, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including loss of profits, revenue, goodwill, data, content, use, business opportunity, or educational opportunity, arising from or related to your use of the service.

To the maximum extent permitted by law, our total liability for any claim arising from or related to the service will not exceed the amount you paid to English AIdol for the service giving rise to the claim during the three months before the event giving rise to liability, or one hundred United States dollars (US $100), whichever is greater.

17. Indemnification

You agree to defend, indemnify, and hold harmless English AIdol and its officers, employees, contractors, agents, affiliates, and licensors from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising from or related to your use of the service, User Content, violation of these Terms, violation of law, or infringement of third-party rights.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws applicable to the jurisdiction in which English AIdol operates, without regard to conflict-of-law principles. You agree to first contact us at [email protected] and attempt to resolve any dispute informally before initiating formal proceedings.

Nothing in these Terms limits rights that cannot be waived under applicable consumer protection laws.

19. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date above. If changes are material, we may provide additional notice where required. Continued use of the service after updated Terms are posted means you accept the updated Terms.

20. Miscellaneous

These Terms, together with the Privacy Policy and any applicable supplemental terms, constitute the entire agreement between you and English AIdol regarding the service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, reorganization, or transfer of assets.
